We all take a tumble now and then, but some slips and falls result in serious injuries – and in some cases, they’re a consequence of negligence on the part of property owners.
Do you have a claim?
Property owners and operators, in a shopping mall for example, are required by law to take reasonable precautions to protect visitors and patrons from injury.
Reasonable efforts need to be made by the owner or operator to ensure that:
- surfaces aren’t unduly slippery
- dangerous areas are demarcated
- walkways are unobstructed
- all areas are adequately lit
- railings and barriers are in place where there’s a risk of falling from a height
- holes and cracks are repaired promptly
- areas that are slippery or wet have the proper warning signs.
If you fall and injure yourself because reasonable safeguards like these are missing, you might have grounds to claim compensation.
What to consider before proceeding with a claim
Before you file a claim, there are a few things to take into consideration.
Was the cause of your slip or fall an obvious example of negligence by the property owner or another responsible party?
For example, a claim is less likely to succeed if you disregarded signage or if your injury resulted from the actions of another patron.
Typically, it’s worth proceeding with a claim only for more serious injuries. Injuries that are considered chronic, life threatening or crippling, that lead to loss of income or that incur a lot of medical bills are the most common candidates for injury claims.
To support a claim, it’s best to get immediate medical attention and to keep all medical records associated with your injury.
It’s also a good idea to take photos of the area and cause of the fall, and to record the contact details of any witnesses.
